25 March 2009 CPR Message: Implementation of Revised Lacey Act Provisions The following notice is from Canadian Pacific. This is a reminder that the U.S. Department of Agriculture (USDA) Animal and Plant Health Inspection Service (APHIS) will begin phased enforcement of the Lacey Act declaration requirement for goods of, or containing, plants or plant products effective April 1, 2009. The Food, Conservation, and Energy Act of 2008 amended the Lacey Act to provide, among other things that importers submit a declaration at the time of importation for certain plants and plant products, and for manufactured items containing plant products. For the purposes of satisfying this requirement the import declaration must include the following additional information: * Scientific name of the plant * Value of the importation * Quantity of the plant * Name of the country from which the plant was harvested The details of the U.S. Department of Agriculture's "Phase-In Schedule of Enforcement of the Declaration Requirement for Goods of, or Containing, Plants or Plant Products" is available at: http://www.aphis.usda.gov/plant_health/lacey_act/downloads/FederalRegister02-03-2009.pdf Additional details are also available on the USDA APHIS website at: http://www.aphis.usda.gov/plant_health/lacey_act/index.shtml Canadian Pacific encourages shippers and importers to review the details of this change closely, and in conjunction with their broker. In particular procedures must be in place to manage the commodities covered in absence of the CBP Line Release entry option.
