Milk protein substances with a milk protein content of 85% or more by weight, calculated on the dry matter, that do not originate in a NAFTA country, an EU country or other CETA beneficiary, Chile, Costa Rica or Israel

Imports of milk protein substances (MPS) with a milk protein content of 85% or more by weight, calculated on the dry matter, that do not originate in a NAFTA country, an EU country or other CETA beneficiary, Chile, Costa Rica or Israel into Canada are subject to import controls under Canada’s Export Import Permit Act.

The purpose of this message is to inform importers that only products that qualify as “originating products” within the meaning of the concerned trade agreement are exempted from Canada`s import permit requirements for MPS.

For example, products that satisfy the CETA protocol on rules of origin and origin procedures are eligible to enter Canada without need of an import permit when imported directly from the EU to Canada. In the event that goods are shipped to Canada via a third country, the requirements set out in Article 14 (Transport through a third country) must be met in order to qualify.

If a product does not qualify as originating under the concerned trade agreement, or if transhipment requirements are not satisfied, an import permit is required.

Import permits for shipments of MPS destined to the Canadian market are issued to allocation holders under Canada’s global tariff-rate quota (TRQ) for MPS, which is administered by Global Affairs Canada.
