SIMA Undertaking Review re Certain Oil and Gas Well Casing from Japan

This is to advise that the Department has initiated a review of the undertakings with respect to certain oil and gas well casing originating in or exported from Japan on 7 July 1998, pursuant to the Special Import Measures Act.

These goods are properly classified under the following eight digit Harmonized System tariff numbers:

7304.29.00
7306.20.10
7306.20.90

All references to sections of the Special Import Measures Act (SIMA) refer to the Act which was in place prior to the amendments introduced on 1 January 1 1995. The original investigation and undertakings were entered into prior to that date, and consequently the Department is required to follow the former undertaking provisions of the law.

The undertakings in question were accepted on 18 November 1986, which resulted in a suspension of an anti- dumping investigation involving certain oil and gas well casing from the Federal Republic of Germany and Japan. The undertakings were subsequently renewed for three year terms on 17 November 1989, 16 November 1992 and 15 November 1995. In accordance with the undertaking provisions contained in SIMA, the Department is required to review these undertakings before the expiration of three years from the date they were renewed.

The purpose of this review is to determine whether the undertakings continue to serve the purpose for which they were intended.

Notice of the completion of this undertaking review will be published in a Canada Gazette.
