Update to CSCB Advocacy Material

Members may wish to note the addition of a link to the Department of Foreign Affairs and International Trade web site from the CSCB advocacy material. This link, which appears in the DFAIT Consultative Committee area on the welcome page of the advocacy area, takes members to a video demonstration of the EICS Release 1; this demonstration shows the procedures for logging onto the EICS, applying for a permit, finding and viewing the permit after it is issued, and logging out.

Communications Problems

Members may have noticed irregularities in the receipt of messages via the CSCB list serve over the past two days. Our internet provider experienced technical problems on Friday, and it appears that this has affected our messaging system. You may have received multiple copies of e-mail messages from us, and earlier this morning a test message was sent that contained garbled information; please ignore that message.

We have addressed this problem with our service provider, and hope to have a solution soon! We apologize for any inconvenience, and thank you for your patience.

Customs Proposal 004

Members may have recently received by mail Customs Proposal 004, which refers to the Authority to Act as Agent. Since the Canada Customs and Revenue Agency's (CCRA) initial proposal to require brokers to complete RC59, Business Consent Form, the CSCB has communicated to the CCRA on several occasions our concerns regarding multiple authorization forms. Although we have been advised by our legal counsel that the existing agency agreement text authored by the CSCB for use by members provides brokers with the authority necessary to apply for such information, we will be reviewing our agreement once again in the context of the recent Customs Proposal.

We have already advised the CCRA that we will be submitting a formal response to Proposal 004. Members with comments or questions are asked to submit them in writing to the CSCB National Office as soon as possible. Once finalized, the text of the CSCB submission will be made available to members through our regular email service.

Transmission of Accounting Data via CADEX for Goods Released as Non-CADEX

The following letter to the CSCB was issued by Jan Gahagan, Manager of the Entry, Accounting and Adjustment Policy Section of the Import Process Division of the CCRA, in response to the CSCB's letter regarding the transmission of accounting data via CADEX for goods released as non-CADEX. Members are welcome to send their comments on this issue to the CSCB national office.

This is in response to your letter dated August 11, 2000 regarding the issue of utilizing electronic entry transmissions for shipments released via the traditional hard-copy Release on Minimum Documentation (RMD) process.

Your interpretation of customs memorandum D17-1-5 is correct in that importers and brokers are permitted to transmit accounting data via CADEX irrespective of the release occurring in an electronic or paper-based environment and regardless of the completeness of supporting documentation at time of release.

In circumstances where a CADEX entry is transmitted for a hard-copy RMD release, any supporting documentation such as an invoice that is missing at time of release, must be submitted at or prior to the date of final accounting to the customs office of release. Please note that the transaction number must be noted on the supporting documentation.

I appreciate being made aware that customs memorandum D17-1-5 requires some clarification on this matter and hope that I have adequately addressed your concerns.
