Dispute Notices

Customs Notice N-431, sent by the CSCB to members on February 26, provided information on where to file dispute notices.

Further to this Customs Notice, we now have a copy of draft D-Memorandum 11-6-9. This D-memo provides details on applying for an extension of the usual 90 day time limit for filing a dispute notice under section 60 of the Customs Act.

Please note that in order to file a dispute notice outside of the 90-day period four conditions must be met. These are:

1) The application must be made within 1 year and 90 days of the decision being contested (the ss.59(2) notice in the case of imported goods)
and
2) During the time prior to making the application, the person was either:
a) unable to act or to give a mandate to act in the person's name or
b) had a bona fide intention to make a request
and
3) It would be just and equitable to grant the application
and
4) The application was made as soon as circumstances permitted.
