In the matter of an inquiry, under section 42 of the Special Import Measures Act, respecting:

AUTOMOTIVE LAMINATED WINDSHIELDS FOR THE AUTOMOTIVE REPLACEMENT MARKET, OF ALL SIZES AND SHAPES, WHETHER THEY ARE CLEAR OR TINTED, WHETHER COATED OR NOT, WHETHER OR NOT THEY INCLUDE ANTENNAE, CERAMICS, MIRROR BUTTONS, VIN NOTCHES, AND WHETHER OR NOT THEY ARE ENCAPSULATED, ORIGINATING IN OR EXPORTED FROM THE PEOPLE'S REPUBLIC OF CHINA

Finding

The Canadian International Trade Tribunal, under the provisions of section 42 of the Special Import Measures Act, has conducted an inquiry to determine whether the dumping in Canada of automotive laminated windshields for the automotive replacement market, of all sizes and shapes, whether they are clear or tinted, whether coated or not, whether or not they include antennae, ceramics, mirror buttons, VIN notches, and whether or not they are encapsulated, originating in or exported from the People's Republic of China, has caused injury or retardation or is threatening to cause injury to the domestic industry.

This inquiry is pursuant to the issuance by the Commissioner of the Canada Customs and Revenue Agency of a preliminary determination dated May 2, 2002, and of a final determination dated July 31, 2002, that the aforementioned goods have been dumped and that the margin of dumping of the goods is not insignificant. Pursuant to subsection 43(1) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby finds that the dumping of the aforementioned goods originating in or exported from the People's Republic of China has not caused material injury and is not threatening to cause material injury to the domestic industry.
