Subject: AMPS Contraventions 274, 345 and 346

The CCRA AMPS working group has advised that the proposed changes to contravention C274 are now in effect. CSCB members were advised of these proposed changes via our e-mail service on 17 December 2003. The proposed change eliminated the "greater of" penalty amount, and penalties are now a flat $1,000.00, $2,000.00 and $3,000.00.

We had been advised previously that penalties issued under C274, at any time, will be assessed at the flat rate, and are awaiting confirmation that this remains true.

It was noted by the CSCB that penalties on the proposed version of C274 were assessed on a per transaction basis, but that the approved version of C274 indicates that the penalty amounts will be assessed on a per shipment basis. We have contacted the CCRA regarding this discrepancy and have been advised that more changes to this contravention will be announced shortly. The final version will be circulated to members once received.

Contraventions 345 and 346 have had the word "strategic" removed.
