Request No. TR-2002-006, Certain Polyester/Cotton Woven Fabrics
On 11 April 2003 the CITT gave notice that it was satisfied that the request received from CS Brooks Inc. of Magog, QC was properly documented. The request is for the removal, for an indeterminate period of time, of the customs duty on importations from all countries of plain woven fabrics, unbleached or bleached, containing 65 per cent or more by weight of polyester fibres mixed solely with cotton, of a weight not exceeding 170 g/m2, of subheading No. 5407.91 or 5513.11, to be dyed or printed, for use in the manufacture of bedding and home furnishing products (the subject fabrics). The requester has asked the Tribunal to conduct its investigation expeditiously. The Tribunal has examined the request and is not persuaded that the circumstances constitute critical circumstances. However, barring any opposition to the request, the Tribunal intends to conduct its investigation as expeditiously as possible.
The Tribunal will conduct an investigation under section 19 of the CITT Act into the appropriateness of reducing or removing the customs duty on importations of the subject fabrics, which are classified in subheading No. 5407.91 or 5513.11.
The Tribunal’s investigation commenced on 10 April 2003 and will be conducted by way of written submissions. To participate in the Tribunal’s investigation, the requester or an interested party must file with the Tribunal a notice of appearance in Form I of the Textile Reference Guidelines on or before 2 May 2003. The Tribunal’s recommendations to the Minister of Finance are scheduled to be issued by 8 August 2003.
