Request for Textile Tariff Relief No. TR-2003-004

Notice is hereby given that the CITT is satisfied that the request received from Peerless Clothing Inc. of Montreal, PQ is properly documented. The request is for the removal, for an indeterminate period of time, of the customs duty on importations from all countries of woven fabrics of textured polyester filament yarns, partially coated with hot-melt adhesive, with a four per cent minimum stretch in the warp and a 12 per cent minimum stretch in the weft as measured by specification ASTM D3107-75, of a weight not exceeding 70 m/g2, of subheading NO. 5903.90, for use in the manufacture of men’s and boys’ jackets (including suit jackets), blazers and vests (waistcoats) (the subject fabrics). The requester has asked the Tribunal to conduct its investigation expeditiously. The Tribunal has examined the request and is not persuaded that the circumstances constitute critical circumstances. However, barring an opposition to the request, the Tribunal intends to conduct its investigation as expeditiously as possible.

The Tribunal will conduct an investigation under section 19 of the CITT Act into the appropriateness of reducing or removing the customs duty on importations of the subject fabrics, which are classified in subheading No. 5903.90.

The Tribunal’s investigation commenced on 8 June 2004 and will be conducted by way of written submissions. To participate in the investigation, the requester or an interested party must file with the Tribunal a notice of appearance in Form I of the Textile Reference Guidelines on or before 29 June 2004. The Tribunal’s recommendations to the Minister of Finance are scheduled to be issued by 6 October 2004.

The schedule of events is available from the CITT web site, at http://www.citt-tcce.gc.ca.
