NOTICE OF DECISION TO COMMENCE A GLOBAL SAFEGUARD INQUIRY AND TO COMBINE PROCEEDINGS

Following a complaint filed by the Canadian Bicycle Manufacturers Association (CBMA) on March 3, 2005, the Canadian International Trade Tribunal (the Tribunal) hereby gives notice that it is commencing, pursuant to subsection 26(1) of the Canadian International Trade Tribunal Act (CITT Act), a global safeguard inquiry into the importation into Canada, from all sources, of finished painted bicycle frames, assembled or unassembled (Safeguard Inquiry No. GS-2004-002).

COMBINING OF PROCEEDINGS

The Tribunal has decided, pursuant to rule 6.1 of the Canadian International Trade Tribunal Rules to combine the proceedings of Safeguard Inquiry No. GS-2004-002 with those of Safeguard Inquiry No. GS-2004-001.

As a result, there will be a single record for the combined proceedings. All correspondence should refer to Safeguard Inquiry Nos. GS-2004-001 and GS-2004-002. The revised schedule under Global Safeguard Inquiry No. GS-2004-001, distributed to interested parties on February 24, 2005, is now applicable to the combined proceedings. The schedule is attached for convenience.

The purpose of this inquiry is to determine: (a) whether bicycles, assembled or unassembled, with a wheel diameter greater than 38.1 centimetres or 15 inches, are being imported into Canada from all sources in such increased quantities and under such conditions as to be a principal cause of serious injury, or threat thereof, to domestic producers of like or directly competitive goods; and (b) whether finished painted bicycle frames, assembled or unassembled, are being imported into Canada from all sources in such increased quantities and under such conditions as to be a principal cause of serious injury, or threat thereof, to domestic producers of like or directly competitive goods.

The Tribunal issued questionnaires to domestic producers, importers and foreign producers of bicycles and frames, on March 8, 2005, as part of its Global Safeguard Inquiry GS-2004-001, requesting relevant statistical and other information for the years 2000 to 2004. The Tribunal also issued market characteristics questionnaires to certain purchasers of bicycles and bicycle frames. The information gathered through these questionnaires will be used in the combined proceedings. Copies of these questionnaires were made available on the Tribunal's Web site on March 8, 2005, at www.citt-tcce.gc.ca/question/index_e.asp. Responses to the questionnaires are to be returned no later than April 5, 2005.

The Tribunal will issue a report on the inquiry no later than August 9, 2005.

Should the Tribunal make a final determination of serious injury or threat thereof, the Government of Canada may decide on appropriate safeguard measures.

The Tribunal's proceedings will be in accordance with the Canadian International Trade Tribunal Rules.

PARTICIPATION

Notices of participation, notices of representation, and declarations and confidentiality undertakings filed by parties and counsel in Safeguard Inquiry No. GS-2004-001 will be applicable to the combined proceedings. Each additional person or government wishing to participate in the Tribunal's inquiry as a party must file a notice of participation with the Secretary on or before April 11, 2005. Each counsel who intends to represent a party must file a notice of representation and, in order to have access to confidential information, a declaration and confidentiality undertaking with the Secretary on or before April 11, 2005.
