Review of Normal Values and Exporting Prices respecting Bicycles … from Chinese Taipei and PRC

On 18 July 2005 the CBSA announced initiation of a review of normal values and export prices respecting bicycles, assembled or unassembled, with wheel diameters of 16 inches (40.64 cm) and greater, and frames thereof, originating in or exported from Chinese Taipei and the PRC, excluding bicycles with an FOB Chinese Taipei or PRC selling price exceeding CAD 225, excluding bicycles with foldable frames and stems, and excluding bicycle frames with an FOB Chinese Taipei or PRC selling price exceeding CAD 50. This review is part of the CBSA’s enforcement of the CITT’s injury finding of 11 December 1992 and continued on 10 December 1997 and 9 December 2002.

The subject goods are normally imported into Canada under one of the following ten-digit HS classification numbers:

It is anticipated that this re-investigation will be concluded on or before 18 January 2006.

Notice of completion of this re-investigation will be published in a Customs Notice.

Importers are cautioned that the cost of production information on which the normal values of the 2004-2005 models were based will verified during the current review. If any of the information provided by the exporters was found to be inaccurate, the normal values will be re-established and the entries reappraised in light of the new information. This may result in additional dumping duties being assessed against the importer.

Importers are advised that if an exporter fails to provide a complete and accurate submission by 24 August 2005, the finalized 2005 normal values will be based on the best information available. This may result in retroactive assessments of additional dumping duties against the importer as high as 64 per cent of the export price for all imports of subject bicycles and frames purchased from that exporter since 1 September 2004.

Finally, importers are advised that they must respond to the questionnaire sent at the initiation of the re-investigation by the due date of 8 August 2005. If they fail to present a complete and accurate submission, the finalized export prices for 2005 models will be based on the best information available. This may result in retroactive assessments of additional dumping duties by reducing the export prices by 21.2 per cent for all imports of subject bicycles and frames purchased since 1 September 2004.
