Issue: Whether the good in issue is properly classified under tariff item No. 8703.90.00 as other motor cars and other motor vehicles principally designed for the transport of persons (other than those of heading No. 87.02), including station wagons and racing cars, as determined by the President of the Canada Border Services Agency, or whether its importation should be exempted from the application of the Customs Act, as claimed.
