ECCC: Information on Reporting for Products Containing Mercury

Reminder: Your 2019 imports/manufacture of products containing mercury will need to be reported in 2020.

You are receiving this email as Environment and Climate Change Canada (ECCC) has reason to believe that you are involved in importing or manufacturing activities, or otherwise interested in the Products Containing Mercury Regulations (the Regulations). In 2017, many companies in your sector submitted reports regarding their 2016 importing and manufacturing activities involving products containing mercury. We encourage you to meet this mandatory requirement for the next reporting year, should it apply to your situation.

The Regulations came into force in 2015 and prohibit the import and manufacture of products containing mercury, or any of its compounds, with some exemptions for essential products, which have no technically or economically viable alternatives. Manufacturers and importers of exempted or permitted products are required to report to ECCC every three years via the online reporting system for the Regulations.

As we are entering the new calendar year, we would like to remind you that:
All imports and manufacture of exempted or permitted products containing mercury during 2019 will need to be reported by March 31st, 2020.

For more details on reporting requirements, please refer to section 12 of the Regulations at https://laws-lois.justice.gc.ca/PDF/SOR-2014-254.pdf.

REPORTING GUIDANCE

Comprehensive guidance material and resources are available on the Products Containing Mercury Regulations website at canada.ca/mercury-products to facilitate your reporting, including:

  • A downloadable table in which you can start documenting your 2019 import and manufacture activities. You will be able to copy/paste the table into the online system later
  • A user guide for the online reporting system.

 RECORD KEEPING REQUIREMENTS

  • Records and supporting documentation for every activity must be kept for a minimum of five years.
  • Specific information, such as the product’s name, the quantity of mercury in each product, and date of manufacture or import, must be included in your records. For a complete list of the required information, please consult section 14 of the Regulations.

Please do not hesitate to contact us with any questions, and send us an email to confirm business information and contacts, so that we may direct you to the information and resources that are available to help you understand the requirements of the Regulations.
