CSBA has provided addition clarification for customs brokers at port 395.

Container shipments at the Port

If the terminal (ie MGT, Termont) has indicated the container is ready for pickup, then you do not need a customs stamp for release. With the arrival of vessels CBSA, is advising the terminals which shipments are released based upon the terminal’s arrival list. The transport can schedule pick up of the containers in these cases. If not ready for pickup, contact the terminal first to see if they have received instructions of release for the container. 

Containers transferred to the warehouse for destuffing

The customs broker should proceed as usual and will transmit their entry in SWI (Single Window), to which an IID-accepted message will be received. Once received, if no release is received, send a copy of the Customs Manifest to [email protected] with the typed or barcoded transaction number on the manifest. CBSA will check its status, and if authorized for release it will be returned with a release stamp. Do not provided an MDM package as it is not required in this instance, unless specifically requested by an officer.

What will be the release date for the entries?

Due to the system issues, once the Marine Cargo Data can be received into the system, it will trigger the releases in the system. The date that the system is able to trigger a release will be the date of the release, and you will have 5 days from that date to account for the goods. In other words the releases will not be back dated once the system returns to regular operation.

This being said, it is important that customs brokers keep an eye on shipments to ensure that shipments are delivered, and once transmission recommences, that you have the release status on shipments affected.
