NCR consultation on proposed amendments to the Contraventions Regulations

NRC invites you and your organization to comment on the proposal made to designate, as ticketable offences under the Contraventions Act and its accompanying regulations, the Contraventions Regulations, various minor regulatory offences under regulations of the Canadian Environmental Protection Act, 1999 (CEPA 1999). 

The proposal appears on the CEPA Environmental Registry at http://www.ec.gc.ca/lcpe-cepa/default.asp?lang=En&n=B43DD412-1&toc=show.

As indicated in the CEPA 1999 Compliance and Enforcement Policy, tickets are available as an enforcement measure for minor regulatory offences which have minimal or no threat to the environment or human life or health. Using tickets provides an overall less costly and less time-consuming alternative to summary convictions, to deal with individuals or companies that violate CEPA 1999 regulations and who commit, for example, the offence of:

  • failing to sign a report required to be submitted to the Minister of Environment under a given CEPA 1999 regulations;
  • failing to file a report (that is, one containing all the information required by the regulations); etc. 

The Contraventions Act maintains the right of any alleged violator to make representations or contest the fines associated with the offence before the court.
