Notice of conclusion of expiry review investigation: Carbon Steel Welded Pipe 2 (CSWP2 2023 ER)

On August 21, 2023, the Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(1) of the Special Import Measures Act (SIMA), initiated an expiry review of its order made on October 15, 2018, in Expiry Review No. RR-2017-005, concerning the dumping of certain carbon steel welded pipe originating in or exported from the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei), the Republic of India (India), the Sultanate of Oman (Oman), the Republic of Korea (South Korea), the Kingdom of Thailand (Thailand) and the United Arab Emirates (UAE) and the subsidizing of the aforementioned goods originating in or exported from India.

As a result, on August 22, 2023, the Canada Border Services Agency (CBSA) initiated an expiry review investigation to determine whether the expiry of the order is likely to result in the continuation or resumption of dumping and/or subsidizing of the goods.

The investigation has now been completed and today, pursuant to paragraph 76.03(7)(a) of SIMA, the CBSA has determined that the expiry of the order:

  1. is likely to result in the continuation or resumption of dumping of such goods originating in or exported from Chinese Taipei, India, Oman, South Korea, Thailand and the UAE; and
  2. is likely to result in the continuation or resumption of subsidizing of such goods originating in or exported from India

A Statement of Reasons that contains additional details concerning the determinations made by the CBSA will be issued within 15 days.

The CITT will now conduct an inquiry to determine whether the expiry of its order is likely to result in injury to the Canadian industry and has announced that it will issue its decision no later than June 26, 2024.

Avis de conclusion de l’enquête sur le réexamen relatif à l’expiration : Tubes soudés en acier au carbone 2 (CSWP2 2023 ER)

Le 21 août 2023, le Tribunal canadien du commerce extérieur (TCCE), conformément au paragraphe 76.03(1) de la Loi sur les mesures spéciales d’importation (LMSI), a ouvert un réexamen relatif à l’expiration de son ordonnance rendue le 15 octobre 2018, dans le cadre du réexamen relatif à l’expiration no RR-2017-005, concernant le dumping de certains tubes soudés en acier au carbone originaires ou exportés du Territoire douanier distinct de Taiwan, Penghu, Kinmen et Matsu (Taipei chinois), de l’Inde, d’Oman, de la Corée du Sud, de la Thaïlande et des Émirats arabes unis et le subventionnement des marchandises susmentionnées originaires ou exportées de l’Inde.

Par conséquent, le 22 août 2023, l’Agence des services frontaliers du Canada (ASFC) a ouvert une enquête sur le réexamen relatif à l’expiration afin de déterminer si l’expiration de l’ordonnance occasionnera vraisemblablement la poursuite ou la reprise du dumping et(ou) du subventionnement des marchandises en cause.

L’enquête est maintenant terminée et l’ASFC a aujourd’hui décidé, en conformité avec l’alinéa 76.03(7)a) de la LMSI, que l’expiration de l’ordonnance :

  1. causera vraisemblablement la poursuite ou la reprise du dumping de ces marchandises originaires ou exportées du Taipei chinois, de l’Inde, d’Oman, de la Corée du Sud, de la Thaïlande et des Émirats arabes unis; et
  2. causera vraisemblablement la poursuite ou la reprise du subventionnement de ces marchandises originaires ou exportées de l’Inde.

Un Énoncé des motifs, renfermant des détails additionnels relatifs aux décisions de l’ASFC, sera publié d’ici 15 jours.

Le TCCE mènera maintenant une enquête afin de déterminer si l’expiration de l’ordonnance causera vraisemblablement un dommage à la branche de production nationale et celui ci a annoncé qu’il rendra sa décision au plus tard le 26 juin 2024.
