Notice of conclusion of expiry review investigation, Certain concrete reinforcing bar

On March 29, 2022, the Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiated an expiry review of its finding made on May 3, 2017, in Inquiry No. NQ-2016-003, concerning the dumping of certain concrete reinforcing bar originating in or exported from Belarus, the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei), the Hong Kong Special Administrative Region of the People’s Republic of China (Hong Kong), Japan, Portugal and Spain.

As a result, on March 30, 2022, the Canada Border Services Agency (CBSA) initiated an expiry review investigation to determine whether the expiry of the CITT’s finding is likely to result in the continuation or resumption of dumping of the subject goods.

The expiry review investigation has now been completed and today, pursuant to paragraph 76.03(7)(a) of SIMA, the CBSA has determined that the expiry of the finding is likely to result in the continuation or resumption of dumping of such goods originating in or exported from Belarus, Chinese Taipei, Hong Kong, Japan, Portugal and Spain.

A Statement of Reasons that contains additional details concerning the determination made by the CBSA will be issued within 15 days.

The CITT will now conduct an expiry review to determine if the continued or resumed dumping is likely to result in injury to the domestic industry, and has announced that it will issue its order no later than February 2, 2023.

Avis de conclusion de l’enquête sur le réexamen relatif à l’expiration

Le 29 mars 2022, le Tribunal canadien du commerce extérieur (TCCE), conformément au paragraphe 76.03(3) de la Loi sur les mesures spéciales d’importation (LMSI), a ouvert un réexamen relatif à l’expiration de ses conclusions rendues le 3 mai 2017, dans le cadre de l’enquête numéro NQ-2016-003, concernant le dumping de certaines barres d’armature pour béton originaires ou exportées du Bélarus, du Territoire douanier distinct de Taiwan, Penghu, Kinmen et Matsu (Taipei chinois), de la Région administrative spéciale de Hong Kong de la République populaire de Chine (Hong Kong), du Japon, du Portugal et de l’Espagne.

L’Agence des services frontaliers du Canada (ASFC) a donc ouvert, le 30 mars 2022, sa propre enquête sur le réexamen relatif à l’expiration pour déterminer si l’expiration des conclusions du TCCE causera vraisemblablement la poursuite ou la reprise du dumping des marchandises en cause.

L’ASFC a conclu aujourd’hui son enquête sur le réexamen relatif à l’expiration et a déterminé, en vertu de l’alinéa 76.03(7)a) de la LMSI, que l’expiration des conclusions causerait vraisemblablement la poursuite ou la reprise du dumping de telles marchandises originaires ou exportées du Bélarus, du Taipei chinois, de Hong Kong, du Japon, du Portugal et de l’Espagne.

Un Énoncé des motifs contenant de plus amples renseignements concernant la décision prise par l’ASFC sera publié d’ici 15 jours.

Le TCCE va maintenant mener un réexamen relatif à l’expiration pour déterminer si la poursuite ou la reprise du dumping causera vraisemblablement un dommage à la branche de production nationale. Le TCCE a annoncé que son ordonnance sera rendue d’ici le 2 février 2023.
