Notice of conclusion of expiry review investigation: Cold-rolled steel (CRS 2023 ER)

On November 14, 2023, the Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(1) of the Special Import Measures Act (SIMA), initiated an expiry review of its finding made on December 21, 2018, in Inquiry No. NQ-2018-002, concerning the dumping and subsidizing of certain cold-rolled steel originating in or exported from China, South Korea and Vietnam.

As a result, on November 15, 2023, the Canada Border Services Agency (CBSA) initiated an expiry review investigation to determine whether the expiry of the finding is likely to result in the continuation or resumption of dumping and/or subsidizing of the subject goods.

The investigation has now been completed and today, pursuant to paragraph 76.03(7)(a) of SIMA, the CBSA has determined that the expiry of the finding is likely to result in the continuation or resumption of dumping and subsidizing of certain certain cold-rolled steel originating in or exported from China, South Korea and Vietnam.

A Statement of Reasons that contains additional details concerning the determination made by the CBSA will be issued within 15 days.

The CITT will now conduct an inquiry to determine whether the expiry of its finding is likely to result in injury to the Canadian industry and has announced that it will issue its decision no later than September 19, 2024.

Avis de conclusion de l’enquête sur le réexamen relatif à l’expiration : Feuilles d’acier laminées à froid (CRS 2023 ER)

Le 14 novembre 2023, le Tribunal canadien du commerce extérieur (TCCE), conformément au paragraphe 76.03(1) de la Loi sur les mesures spéciales d’importation (LMSI), a ouvert un réexamen relatif à l’expiration de ses conclusions rendues le 21 décembre 2018, dans le cadre de l’enquête numéro NQ-2018-002, concernant le dumping et le subventionnement de certaines feuilles d’acier laminées à froid originaires ou exportées de la Chine, de la Corée du Sud et du Vietnam.

Par conséquent, le 15 novembre 2023, l’Agence des services frontaliers du Canada (ASFC) a ouvert une enquête pour déterminer si l’expiration des conclusions causera vraisemblablement la poursuite ou la reprise du dumping et(ou) subventionnement des marchandises en cause.

L’enquête est maintenant terminée et l’ASFC a décidé aujourd’hui, en vertu de l’alinéa 76.03(7)a) de la LMSI, que l’expiration des conclusions causera vraisemblablement la poursuite ou la reprise du dumping et du subventionnement de certaines feuilles d’acier laminées à froid originaires ou exportées de la Chine, de la Corée du Sud et du Vietnam.

Un Énoncé des motifs, renfermant des détails additionnels relatifs à la décision de l’ASFC, sera publié d’ici 15 jours.

Le TCCE mènera maintenant une enquête afin de déterminer si l’expiration de ses conclusions causera vraisemblablement un dommage à la branche de production nationale et celui ci a annoncé qu’il rendra sa décision au plus tard le 19 septembre 2024.
