Notice of conclusion of expiry review investigation: Dry wheat pasta (DWP 2023 ER)

On May 15, 2023, the Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(1) of the Special Import Measures Act (SIMA), initiated an expiry review of its finding made on July 26, 2018, in inquiry NQ-2017-005, concerning the dumping and subsidizing of dry wheat pasta originating in or exported from Türkiye.

As a result, on May 16, 2023, the Canada Border Services Agency (CBSA) initiated an expiry review investigation to determine whether the expiry of the finding is likely to result in the continuation or resumption of dumping and/or subsidizing of the subject goods.

The investigation has now been completed and today, pursuant to paragraph 76.03(7)(a) of SIMA, the CBSA has determined that the expiry of the finding:

  1. is likely to result in the continuation or resumption of dumping of such goods originating in or exported from Türkiye and
  2. is likely to result in the continuation or resumption of subsidizing of such goods originating in or exported from Türkiye

A Statement of Reasons that contains additional details concerning the determinations made by the CBSA will be issued within 15 days.

The CITT will now conduct an inquiry to determine whether the expiry of the finding is likely to result in injury to the Canadian industry and has announced that it will issue its decision no later than March 20, 2024.

Avis de conclusion de l’enquête sur le réexamen relatif à l’expiration : Pâtes alimentaires séchées à base de blé (DWP 2023 ER)

Le 15 mai 2023, le Tribunal canadien du commerce extérieur (TCCE), conformément au paragraphe 76.03(1) de la Loi sur les mesures spéciales d’importation (LMSI), a ouvert un réexamen relatif à l’expiration de ses conclusions rendues le 26 juillet 2018, dans le cadre de l’enquête NQ-2017-005, concernant le dumping et le subventionnement des pâtes alimentaires séchées à base de blé originaires ou exportés de Turquie.

Par conséquent, le 16 mai 2023, l’Agence des services frontaliers du Canada (ASFC) a ouvert une enquête sur le réexamen relatif à l’expiration afin de déterminer si l’expiration des conclusions occasionnera vraisemblablement la poursuite ou la reprise du dumping et(ou) du subventionnement des marchandises en cause.

L’enquête est maintenant terminée et l’ASFC a rendu aujourd’hui des décisions, en conformité avec l’alinéa 76.03(7)a) de la LMSI, que l’expiration des conclusions:

  1. causera vraisemblablement la poursuite ou la reprise du dumping de ces marchandises originaires ou exportées de Turquie; et
  2. causera vraisemblablement la poursuite ou la reprise du subventionnement de ces marchandises originaires ou exportées de Turquie.

Un Énoncé des motifs, renfermant des détails additionnels relatifs aux décisions de l’ASFC, sera publié d’ici 15 jours.

Le TCCE mènera maintenant une enquête afin de déterminer si l’expiration des conclusions causera vraisemblablement un dommage à la branche de production nationale et celui-ci a annoncé qu’il rendra sa décision au plus tard le 20 mars 2024.
