USCBP Test Concerning Entry of Section 321 Low-Value Shipments Through the Automated Commercial Environment (ACE)

The USCBP has published a notice in the Federal Register of a new modification to Section 321 Low Value Shipments (also known as Entries Type 86) with a planned implementation date of February 15th, 2024.  The full notice is available here: https://www.federalregister.gov/documents/2024/01/16/2024-00698/test-concerning-entry-of-section-321-low-value-shipments-through-the-automated-commercial

Type 86 entries will now be required to have all documentation filed “upon or prior to arrival,” compared to the previous requirement of filing the necessary information 15 days prior to arrival.  The notice also includes consequences for misconduct in the Type 86 entries and includes potential civil and criminal penalties as well as liquidated damages and administrative sanctions for violation of Type 86 rules, reasonable care requirements, or evading regulations not waived under the Type 86.
