1. This notice provides clarification regarding trans-border air shipments in highway service (flying trucks) and the responsibility of air carriers who transmit pre-arrival Advance Commercial Information (ACI) to the Canada Border Services Agency (CBSA).
2. As per the Reporting of Imported Goods Regulations, air carriers must transmit pre-arrival data to the CBSA for all non-exempt cargo and the conveyance entering or transiting Canada. Cargo and conveyance data may be transmitted up to 30 days in advance and the CBSA encourages clients to transmit pre-arrival data as early as possible.
3. Currently, flying truck cargo is exempt from ACI data in the air mode and it is the highway carrier’s responsibility to transmit conveyance data to CBSA. No pre-arrival data is required from the air carrier.
4. For a flying truck movement, where ACI cargo has been transmitted to the CBSA by the air carrier, risk assessed by the CBSA, and a hold has been placed on the cargo by the CBSA, the air carrier must not cancel the air cargo report. The ACI air cargo report should remain on file with the CBSA even though the goods will be arriving via truck.
5. All other flying truck requirements and procedures as outlined in Memorandum D3-2-1, Air Pre-arrival and Reporting Requirements are still mandatory and must be followed by the air carrier.
6. Please note that this policy change is an interim process until an electronic multi-modal process is in place for pre-arrival transmissions of air cargo.
