On November 8, 2021, the Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiated an expiry review of its orders made on November 28, 2016, in Expiry Review No. RR‑2015‑003, concerning the dumping of copper pipe fittings originating in or exported from the United States, Korea and China and the subsidizing of such goods originating in or exported from China.
As a result, on November 9, 2021, the Canada Border Services Agency (CBSA) initiated an expiry review investigation to determine whether the rescission of the orders is likely to result in the continuation or resumption of dumping and/or subsidizing of the subject goods.
The investigation has now been completed and today, pursuant to paragraph 76.03(7)(a) of SIMA, the CBSA has determined that the rescission of the orders:
- is likely to result in the continuation or resumption of dumping of such goods originating in or exported from the United States, Korea and China and
- is likely to result in the continuation or resumption of subsidizing of such goods originating in or exported from China
A Statement of Reasons that contains additional details concerning the determinations made by the CBSA will be issued within 15 days.
The CITT will now conduct an inquiry to determine whether the rescission of the orders is likely to result in injury to the Canadian industry and has announced that it will issue its decision no later than September 14, 2022.

Décision concernant le réexamen relatif à l’expiration, Raccords de tuyauterie en cuivre
Le 8 novembre 2021, le Tribunal canadien du commerce extérieur (TCCE), conformément au paragraphe 76.03(3) de la Loi sur les mesures spéciales d’importation (LMSI), a débuté un réexamen relatif à l’expiration des ordonnances rendues le 28 novembre 2016, dans le cadre du réexamen relatif à l’expiration numéro RR‑2015‑003, concernant le dumping de raccords de tuyauterie en cuivre originaires ou exportés des États‑Unis, de la Corée et de Chine, et sur le subventionnement de raccords de tuyauterie en cuivre originaires ou exportés de Chine.
Par conséquent, le 9 novembre 2021, l’Agence des services frontaliers du Canada (ASFC) a ouvert une enquête sur le réexamen relatif à l’expiration afin de déterminer si l’expiration des ordonnances occasionnera vraisemblablement la poursuite ou la reprise du dumping et(ou) du subventionnement des marchandises en cause.
L’enquête est maintenant terminée et l’ASFC a rendu aujourd’hui des décisions, en conformité avec l’alinéa 76.03(7)a) de la LMSI, que l’expiration des ordonnances :
- causera vraisemblablement la poursuite ou la reprise du dumping de ces marchandises originaires ou exportées des États‑Unis, de la Corée et de Chine; et
- causera vraisemblablement la poursuite ou la reprise du subventionnement de ces marchandises originaires ou exportées de Chine.
Un Énoncé des motifs, renfermant des détails additionnels relatifs aux décisions de l’ASFC, sera publié d’ici 15 jours.
Le TCCE mènera maintenant une enquête afin de déterminer si l’expiration de ses ordonnances causera vraisemblablement un dommage à la branche de production nationale et celui‑ci a annoncé qu’il rendra sa décision au plus tard le 14 septembre 2022.
