Notice of conclusion of expiry review investigation: Carbon Steel Welded Pipe 3 (CSWP3 2023 ER)

On December 11, 2023, the Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(1) of the Special Import Measures Act (SIMA), initiated an expiry review of its finding made on February 15, 2019, in Inquiry No. NQ-2018-003, concerning the dumping of certain carbon steel welded pipe originating in or exported from the Islamic Republic of Pakistan (Pakistan), the Republic of the Philippines (the Philippines), the Republic of Türkiye (Türkiye) and the Socialist Republic of Vietnam (Vietnam).

As a result, on December 12, 2023, the Canada Border Services Agency (CBSA) initiated an expiry review investigation to determine whether the expiry of the finding is likely to result in the continuation or resumption of dumping of the goods.

The investigation has now been completed and today, pursuant to paragraph 76.03(7)(a) of SIMA, the CBSA has determined that the expiry of the finding is likely to result in the continuation or resumption of dumping of such goods originating in or exported from Pakistan, the Philippines, Türkiye and Vietnam.

A Statement of Reasons that contains additional details concerning the determination made by the CBSA will be issued within 15 days.

The CITT will now conduct an inquiry to determine whether the expiry of its finding is likely to result in injury to the Canadian industry and has announced that it will issue its decision no later than October 16, 2024.

Avis de conclusion de l’enquête sur le réexamen relatif à l’expiration : Tubes soudés en acier au carbone 3 (CSWP3 2023 ER)

Le 11 décembre 2023, le Tribunal canadien du commerce extérieur (TCCE), conformément au paragraphe 76.03(1) de la Loi sur les mesures spéciales d’importation (LMSI), a ouvert un réexamen relatif à l’expiration de ses conclusions rendues le 15 février 2019, dans le cadre de l’enquête numéro NQ-2018-003, concernant le dumping de certains tubes soudés en acier au carbone originaires ou exportés de la République islamique du Pakistan (Pakistan), de la République des Philippines (Philippines), de la République de Turquie (Turquie) et de la République socialiste du Vietnam (Vietnam).

Par conséquent, le 12 décembre 2023, l’Agence des services frontaliers du Canada (ASFC) a ouvert une enquête sur le réexamen relatif à l’expiration afin de déterminer si l’expiration de ses conclusions occasionnera vraisemblablement la poursuite ou la reprise du dumping des marchandises en cause.

L’enquête est maintenant terminée et l’ASFC a aujourd’hui décidé, en conformité avec l’alinéa 76.03(7)a) de la LMSI, que l’expiration de ses conclusions causera vraisemblablement la poursuite ou la reprise du dumping de ces marchandises originaires ou exportées du Pakistan, des Philippines, de la Turquie et du Vietnam.

Un Énoncé des motifs, renfermant des détails additionnels relatifs à la décision de l’ASFC, sera publié d’ici 15 jours.

Le TCCE mènera maintenant une enquête afin de déterminer si l’expiration des conclusions causera vraisemblablement un dommage à la branche de production nationale et celui ci a annoncé qu’il rendra sa décision au plus tard le 16 octobre 2024.
