Notice of conclusion of expiry review investigation: Unitized Wall Modules (UWM 2024 ER)

On May 13, 2024, the Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(1) of the Special Import Measures Act (SIMA), initiated an expiry review of its order made on July 3, 2019, in Expiry Review No. RR-2018-002, concerning the dumping and subsidizing of certain unitized wall modules originating in or exported from the People's Republic of China (China).

As a result, on May 14, 2024, the Canada Border Services Agency (CBSA) initiated an expiry review investigation to determine whether the expiry of the order is likely to result in the continuation or resumption of dumping and/or subsidizing of the goods.

The investigation has now been completed and today, pursuant to paragraph 76.03(7)(a) of SIMA, the CBSA has determined that the expiry of the order:

  1. is likely to result in the continuation or resumption of dumping of such goods originating in or exported from China and
  2. is likely to result in the continuation or resumption of subsidizing of such goods originating in or exported from China

A Statement of Reasons that contains additional details concerning the determinations made by the CBSA will be issued within 15 days.

The CITT will now conduct an inquiry to determine whether the expiry of its order is likely to result in injury to the Canadian industry and has announced that it will issue its decision no later than March 19, 2025.

Avis de conclusion de l’enquête sur le réexamen relatif à l’expiration : Modules muraux unitisés (UWM 2024 ER)

Le 13 mai 2024, le Tribunal canadien du commerce extérieur (TCCE), conformément au paragraphe 76.03(1) de la Loi sur les mesures spéciales d’importation (LMSI), a ouvert un réexamen relatif à l’expiration de son ordonnance rendue le 3 juillet 2019, dans le cadre du réexamen relatif à l’expiration numéro RR-2018-002, concernant le dumping et le subventionnement de certains modules muraux unitisés originaires ou exportés de la Chine.

Par conséquent, le 14 mai 2024, l’Agence des services frontaliers du Canada (ASFC) a ouvert une enquête sur le réexamen relatif à l’expiration afin de déterminer si l’expiration de l’ordonnance causera vraisemblablement la poursuite ou la reprise du dumping et/ou du subventionnement des marchandises en cause.

L’enquête est maintenant terminée et l’ASFC a aujourd’hui décidé, en conformité avec l’alinéa 76.03(7)a) de la LMSI, que l’expiration de l’ordonnance :

  1. causera vraisemblablement la poursuite ou la reprise du dumping de ces marchandises originaires ou exportées de la Chine; et
  2. causera vraisemblablement la poursuite ou la reprise du subventionnement de ces marchandises originaires ou exportées de la Chine.

Un Énoncé des motifs, renfermant des détails additionnels relatifs aux décisions de l’ASFC, sera publié d’ici 15 jours.

Le TCCE mènera maintenant une enquête afin de déterminer si l’expiration de l’ordonnance causera vraisemblablement un dommage à la branche de production nationale et celui-ci a annoncé qu’il rendra sa décision au plus tard le 19 mars 2025.
