On April 1, 2026, the Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(1) of the Special Import Measures Act (SIMA), initiated an expiry review of its order made on June 2, 2021, in inquiry NQ-2020-002, concerning whole potatoes, excluding seed potatoes, excluding imports during the period from May 1 to July 31, inclusive, of each calendar year, and excluding red potatoes, yellow potatoes and the exotic potato varieties, regardless of packaging, and white and russet potatoes imported in 50-lb. cartons in the following count sizes: 40, 50, 60, 70 and 80, and excluding whole potatoes certified as organic by a recognized certification agency, originating in or exported from the United States of America, for use or consumption in the province of British Columbia (subject goods).
As a result of the CITT’s expiry review, on April 2, 2026, the Canada Border Services Agency (CBSA) initiated an expiry review investigation to determine, pursuant to paragraph 76.03(7)(a) of SIMA, whether the expiry of the order is likely to result in the continuation or resumption of dumping of the subject goods.
The expiry review investigation has now been completed and today, pursuant to paragraph 76.03(7)(a) of the SIMA, the CBSA determined that the expiry of the order is likely to result in the continuation or resumption of dumping of the subject goods originating in or exported from the United States of America.
A Statement of Reasons that contains additional details concerning the determinations made by the CBSA will be issued within 15 days.
