Notice of initiation of expiry review investigation: Refined sugar (SUG 2026 ER)

On July 2nd, 2026, the Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(1) of the Special Import Measures Act (SIMA), initiated an expiry review of its order made on August 6, 2021, in inquiry RR-2020-003, concerning the dumping of refined sugar, refined from sugar cane or sugar beets, in granulated, liquid and powdered form, originating in or exported from the United States of America, Denmark, the Federal Republic of Germany, the Netherlands and the United Kingdom, and the subsidizing of the aforementioned goods originating in or exported from the European Union.

As a result of the CITT’s expiry review, the Canada Border Services Agency (CBSA) has today initiated an expiry review investigation to determine, pursuant to paragraph 76.03(7)(a) of SIMA, whether the expiry of the order is likely to result in the continuation or resumption of dumping and subsidy of the subject goods. The CBSA will make a determination no later than November 27, 2026, and will issue a Statement of Reasons by December 11, 2026.

The product definition and the applicable tariff classification numbers of the goods subject to the CITT’s finding are accessible on the CBSA’s Measures in force.

As part of its expiry review investigation, the CBSA forwarded questionnaires to Canadian producers, importers and exporters. Any Canadian producers, importers or exporters who have not received a letter from the CBSA and who wish to provide a response to the questionnaire are advised to contact the CBSA Registry for Trade Remedies at the email below.

Responses to all questionnaires are due by August 7, 2026, and must be filed through the CBSA's ACE web application. More information can be found at the links below:
