Notice of initiation of scope proceeding: Certain carbon steel fasteners

The Canada Border Services Agency (CBSA) initiated a scope proceeding on June 2, 2023, under the Special Import Measures Act (SIMA) respecting certain carbon steel fasterners originating in or exported from the People’s Republic of China (China) and the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei).

The scope proceeding is the result of an application filed with the CBSA by National Nail, a potential importer of the goods that are the subject of the application. The scope proceeding will establish whether or not CAMO Edge Screws are subject to the Canadian International Trade Tribunal’s order issued on September 2, 2020, in Expiry Review No. RR-2019-002, concerning the dumping of certain carbon steel fasteners originating in or exported from China and Chinese Taipei and the subsidizing of certain carbon steel fasteners originating in or exported from China.

A notice of the conclusion and a copy of the Statement of reasons, which will provide more details about this proceeding, will be available on or before September 29, 2023.

Avis d’ouverture de procédure sur la portée : Certaines pièces d’attache en acier au carbone 

L’Agence des services frontaliers du Canada (ASFC) a ouvert une procédure sur la portée le 2 juin 2023 en vertu de la Loi sur les mesures spéciales d’importation (LMSI) à l’égard de certaines pièces d’attache en acier au carbone originaires ou exportées de la République populaire de Chine (Chine) et du Territoire douanier distinct de Taiwan, Penghu, Kinmen et Matsu (Taipei chinois).

La procédure sur la portée fait suite à une demande présentée à l’ASFC par National Nail, un importateur potentiel des marchandises faisant l’objet de la demande. La procédure sur la portée permettra d’établir si des vis CAMO Edge sont assujetties ou non à l’ordonnance rendue par le Tribunal canadien du commerce extérieur le 2 septembre 2020 à l’issue du réexamen relatif à l’expiration numéro RR-2019-002 concernant le dumping de certaines pièces d’attache en acier au carbone originaires ou exportées de la Chine et du Taipei chinois ainsi que le subventionnement des mêmes marchandises originaires ou exportées de la Chine.

Un avis de conclusion et une copie de l’Énoncé des motifs, qui donneront plus de précisions sur la procédure, seront publiés au plus tard le 29 septembre 2023.
