Under the authority of the Pest Control Products Act, Health Canada’s Pest Management Regulatory Agency (PMRA) is proposing amendments to the Pest Control Products Regulations, in response to key concerns raised by stakeholders during the 2022 targeted review of the Pest Control Products Act.
The proposed amendments would support the strategic objectives of the PMRA’s transformation agenda by improving transparency and access to information and data, and further strengthening environmental protection in Canada. Specifically, the proposed amendments include: facilitating access to confidential test data (CTD), and clarifying the information needed from applicants to set maximum residue limits for imported foods. In conjunction with the PCPA, the proposed amendments would require the Minister of Health to issue a public notification once such an application has been accepted for review. In addition, the proposed amendments would provide the Minister with explicit authority to require applicants to provide information on both cumulative effects on the environment and on species at risk to better inform pesticide risk assessments.

Written comments on the proposed amendments will be accepted until 24 August 2024, 70 calendar days from 15 June 2024, which is the date of publication in the Canada Gazette, Part I. Modifications proposées au Règlement sur les produits antiparasitaires
Sous le régime de la Loi sur les produits antiparasitaires (LPA), l’Agence de réglementation de la lutte antiparasitaire (ARLA) de Santé Canada propose de modifier le Règlement sur les produits antiparasitaires en réponse aux principales préoccupations soulevées par les intervenants dans le contexte de l’examen ciblé de la LPA en 2022.
Les modifications proposées appuieraient les objectifs stratégiques du programme de transformation de l’ARLA en améliorant la transparence et l’accès aux renseignements et aux données, et en renforçant la protection de la santé humaine et de l’environnement au Canada. Plus particulièrement, elles faciliteraient l’accès aux données d’essai confidentielles (DEC) et préciseraient les renseignements nécessaires pour demander la fixation de limites maximales de résidus pour les denrées importées. Parallèlement à la LPA, ces modifications exigeraient du ministre de la Santé qu’il émette un avis public une fois qu’une telle demande est acceptée à des fins d’examen. En outre, le ministre aurait le pouvoir explicite d’exiger des demandeurs qu’ils fournissent les renseignements relatifs aux effets cumulatifs des produits antiparasitaires sur l’environnement et aux espèces en péril afin que Santé Canada puisse mieux évaluer les risques liés aux pesticides.
L’ARLA mène également des consultations sur un document d’orientation portant sur les façons d’accéder aux DEC en vertu de ces modifications réglementaires.
