The CFIA is currently reviewing and updating import requirements for milk and milk products. During a review of imports in 2019-2020 it was noted that a significant volume of whey products, such as dried whey solubles and liquid whey permeate, were imported from the United States using the end use of “animal feed”. These commodities were declared using the coding 04 04 10 3543 according to the Automated Import Reference System (AIRS).
Commodities approved for feeding to species defined as livestock under the Feeds Act are required to be imported using the end use of “livestock feed”. Most whey protein products that are approved as livestock feed ingredients can be found in AIRS under the coding 04 04 10 3544.
As of January 15, 2021, the end use of “animal feed” will be deleted from AIRS for whey proteins. This communication is being sent to provide sufficient time for you to adjust your importing practices before the changes are implemented. There is no change to what commodities are permitted to be imported, only to how they are declared at the time of import.
