PC 2007-112, Conditions for Exempted Persons Regulations

PC 2007-112 sets out the formulas for determining a person’s annual export limits, as well as the consequences for exceeding that limit. Each year that the person’s exports of softwood lumber exceed the export limit for that year by 0.5 per cent or more, the person’s export limit for the following year will be reduced following the formula set out in the Regulations. If a person’s exports exceed the export limit in four calendar years, the person will no longer be exempted from the export charges under the Softwood Lumber Products Export Charge Act, 2006.

Pursuant to section 107 of the Act, the Conditions for Exempted Persons Regulations are retroactive to 12 October 2006.
