Request for Textile Tariff Relief No. TR-2002-05

Notice is given the the CITT is satisfied that the request received from Peerless Clothing Inc. (the requester) of Montréal, QC is properly documented. The request is for the removal, for an indeterminate period of time, of the customs duty on importations from all countries of dyed, woven fabrics of polyester filament yarns, mixed with single yarns of polyester and cotton, of a weight not exceeding 170 g/m2 , of subheading Nos. 5407.82, for use as pocketing in the manufacture of men’s and boys’ suits, jackets, blazers, vests (waistcoats) and trousers; and dyed, woven fabrics of polyester staple fibres, mixed solely with cotton, of a weight not exceeding 170 170 g/m2, of subheading No. 5513.21, for use as packeting in the manufacture of men’s and boys’ suits, jackets, vests (waistcoats) and trousers (the subject fabrics) . The requester has asked the Tribunal to conduct its investigation expeditiously. The CITT has examined the request and is not persuaded that the circumstances constitute critical circumstances. However, barring any opposition to the request, the Tribunal intends to conduct its investigation as expeditiously as possible.

The Tribunal will conduct an investigation under section 19 of the CITT Act into the appropriateness of reducing or removing the customs duty on importations of the subject fabrics, which are classified in subheading Nos. 5407.82 and 5513.21.

The Tribunal’s investigation commenced on 25 February 2003 and will be conducted by way of written submissions. To participate in the investigation, the requester or an interested party must file with the Tribunal a notice of appearance in Form I of the Textile Reference Guidelines on or before 18 March 2003. The Tribunal’s recommendations to the Minister of Finance are scheduled to be issued by 25 June 2003.

The request is for the removal, for an indeterminate period of time, of the customs duty on importations from all countries of woven fabrics, dyed or of single yarns of different colours , consisting solely of viscose rayon filaments in the warp and cellulose acetate filaments in the weft, measuring less than 200 decitex per single yarn, of a weight not exceeding 100 g/m2 , of subheading Nos. 5408.22 and 5408.23, for use as lining in the manufacture of men’s and boys’ jackets (including suit jackets), blazers and vests (waistcoats) (the subject fabrics). The requester has asked the Tribunal to conduct its investigation expeditiously. The CITT has examined the request and is not persuaded that the circumstances constitute critical circumstances.
