This matter concerns whether the trial judge erred in finding, based on the evidence before him, that the appellant had no reasonable ground to suspect that an offence was committed or was susceptible to be committed, and in granting moral damages. The Customs agents and the RCMP seized and inspected the respondent's horses because they were suspected to have illegal cocaine inside them. Also, the circumstances around the media's broadcasting of the information regarding the seizure was at issue. As well at issue was whether the respondent's action was prescribed.

HELD:

The appeal was dismissed.
