NAFTA Tariff Treatment Appeals - Update

Further to our message of April 12, where we provided details on several ongoing NAFTA Tariff Treatment appeals, the CITT has granted an extension to C.B Powell and will allow an appeal to be filed under Section 67(1) of the Customs Act. We continue to anxiously await the outcome.

The following is excerpted from today's edition of "globeandmail.com". Canada's merchandise exports declined 0.7 per cent in March as a result of falling prices for energy products, while imports grew two per cent on the strength of precious metals. Canada's trade surplus with the world narrowed to $254-million in March from $1.2-billion in February. Export and import volumes increased during the month. Exports decreased to $33.5-billion in March from $33.8-billion in February, halting six straight months of increases.

On May 4, the CSCB sent a message advising that penalties issued for infractions that occurred before April 14, 2010, will be issued at the rate in effect at the time the infraction took place. This information is incorrect. Penalties issued after April 14, regardless of when the contravention occurred, will be assessed at the new rates. This will provide some benefit to those being audited for transactions that took place prior to April 14 and who may be subject to contraventions formerly penalized at the "greater of" two amounts.
